which it is composed) provides access to a selection of photographic
compilations. The products on our website can if requested be made available to
international clients but the main focus is the South African market.

Conditions:
1. About the Terms & Conditions
It is important that you read and understand these
Terms & Conditions. Please pay particular attention to the paragraphs
rendered in bold font as they contain disclaimers that materially affect your
rights. When you access this website, you will be bound in law by the terms
that appear on this web page, except for those terms appearing in paragraph 13
(which apply only when you choose to purchase products via this website). When
you choose to purchase any of our products via this website, the terms set out
in paragraph 13 will also apply to your purchase in addition to the other Terms
& Conditions appearing on this web page. These terms represent an agreement
between you, the person or entity accessing or using this website or purchasing
products via this website, and directly from Actionography CC (CK:
2005/048924/23). Throughout this website Actionography CC refers to this
agreement between you and Actionography CC as the "Terms &
Conditions".
2. Payment Terms, Order
Confirmation
The merchant outlet country (at the time of presenting payment options to the
cardholder) is
* Direct cash or cheque deposits will require 10 days
to confirm payment before the order will be processed.
3. Credit Card Acquiring
and Security
Credit card transactions will be acquired for Actionography CC via PayGate
(Pty) Ltd who are the approved payment gateway for Standard Bank of
4. Deliveries
Actionography CC will arrange to ship the product(s) you
purchase to you usually within 10 working days from payment confirmation. You
must notify us of missing or damaged items in your order within two (2) days of
receiving your product. Deliveries will be conducted & confirmed via the
South African Post Office Limited. Delivery costs are calculated on checkout;
please ensure you have selected the correct delivery method. On delivery to an
overseas client the postage/delivery amount must be attained through the
Actionography cc accounts department.
5. Return Policy *
All CDs, DVDs and all consumable items are final (no refunds or returns)
Actionography does not refund individuals with regards to its CD or website
download product due to the nature of the product itself. Once the product has
been received the control from Actionography falls away therefore the returning
of a product once opened and viewed will not happen. The only time a refund
will be carried out by Actionography cc will be in the instance that a
framed/printed picture is received and is the incorrect picture or frame. The
refund will only be issued for the amount of the sale and will not include
shipping costs. To arrange to return merchandise, call our offices and provide
the order number & item descriptions of the merchandise you wish to return.
Returned merchandise must be in original packaging, and must not have been
tampered with. *All returns shipment
costs will be paid for by customer.
6. Warranties *
There are no warranties for products offered by Actionography CC. We make no
warranties, expressed or implied, except those stated in this section and in
Actionography CC's applicable warranty statement in effect on the date of the

On pre-ordering of any product supplied by Actionography cc, Actionography cc
cannot be held responsible for the non-capture of the product due to
circumstances out of Actionography cc’s control. Actionography will do their
outmost to capture that special moment which creates the product but due to the
nature of the product Actionography cannot be held responsible for the non
captured product.
10. Limitation of
Liability.
Actionography CC does not accept liability beyond the remedies set forth
herein, including any liability for products not being available for purchase or
lost. Actionography CC will not be liable for lost profits, loss of business or
other consequential, special, indirect or punitive damages, even if advised of
the possibility of such damages, or for any claim by any third party except as
expressly provided herein. You agree that for any liability related to the
purchase of products or services bundled with the products, Actionography CC is
not liable or responsible for any amount of damages above the aggregate rand
amount you paid for the purchase governed by this agreement
11. Customer privacy policy
Actionography CC shall take all reasonable steps to protect the personal
information of users. For the purpose of this clause, "personal
information" shall be defined as detailed in the Promotion of Access to

The customer information
captured by Actionography through registration forms, questionnaires and
competitions that pertains to the General Motorgroup
and Reeds Motorgroup businesses will been seen by
Actionography, on completion or participation by an individual, as permission
for the Actionography cc to disclose the details attained through the
participated event to the General Motors group or Reeds motor group themselves.
Only the relevant individuals will be disclosed this information within the
relevant organizations.
12. Dispute resolution
In the event of any dispute of any nature whatsoever arising
between the parties on any matter provided for in, or arising out of this
agreement, and not resolved through Actionography CC management, then such a
dispute shall be submitted to confidential arbitration in terms of the
expedited rules of the Arbitration Foundation of South Africa. Arbitration
proceedings shall be conducted in

Actionography cc’s registration process, with regards to the capture of images and displaying them onto the Actionography website, Actionography cc cannot be held responsible for the envelope placed into the Actionography box provided being stolen or lost due to a third party involvement. Actionography will do its outmost to create a secure and smooth process, but cannot be held liable for any money loss due to circumstances out of Actionographys control.
The registration process that takes place not on the Actionography website at R50 is for the capturing of pictures to be posted onto our website to be viewed and ordered via website payment. The R130 payment is for the order of a two framed jumbo frame that will be captured and delivered once Actionography photographers have captured you in your required sport chosen on the registration form and the capture of further photographs to be placed for viewing and purchase via our Actionography website.
The confirmation of payment either cash or EFT will be required before any action is carried out by Actionography in order to capture your photograph orders.
14. Names &
Trademarks
You will not register or use any Internet domain name that contains
Actionography CC trademark or trade name (i.e. action) in whole or in part or
any other name that is confusingly similar thereto. The section headings used
herein are for convenience of reference only and do not form a part of these
terms and conditions, and no construction or inference shall be derived there
from. If any term of this Agreement is found by a court of competent
jurisdiction to be unenforceable, the enforceability of the remaining
provisions shall not be affected or impaired. This Agreement and any sales
